CD Plus Points Program Terms and Conditions

 

A. Membership in the CD Plus Points Program

1. Membership in the CD Plus Points Program is absolutely free and no initial purchase is required. Simply fill out a CD Plus Points Program Enrollment Form at any CD Plus store and receive your CD Plus Points Card immediately in-store.

2. The CD Plus Points Card is not a credit card.

3. Each CD Plus Points Card has a unique number registered in the Member's name

4. Only one CD Plus Points Card membership is available per customer.

5. CD Plus Points Memberships are only available to individual consumers. CD Plus Points Memberships are not available to corporations, businesses, charities, partnerships, enterprises or anyone other than an individual without written prior consent from CD Plus.  

6. CD Plus reserves the right to refuse issuance of a CD Plus Points Card to any customer who does not follow the prescribed enrollment procedures.

B. Collection of CD Plus Points

1. Members collect CD Plus points on each eligible purchase made at any CD Plus store.

2. CD Plus reserves the right to add or delete items eligible to earn CD Plus Points at any time.

3. Members must present their personal valid CD Plus Points Card to the store cashier prior to the completion of each purchase transaction to collect their CD Plus Points.

4. CD Plus Points will be awarded at the rate of 10 CD Plus Points for each dollar or portion of a dollar spent on each purchase at participating stores calculated on the net (purchase price less discounts) pre-tax total of each cash register receipt. The total CD Plus Points awarded and reflected on the cash register receipt will be rounded up by the next one-tenth of a dollar in favour of the CD Plus Points Member.

5. CD Plus Points will not be issued with purchase of the following items/services: electronic gift cards, delivery charges (where applicable), gift with purchases, charitable donations, the CD Plus Points redemption portion of a transaction, and any other items specified as exclusions from time to time.

6. CD Plus Points will be awarded when a CD Plus Points Member pays for a purchase with an electronic gift card.

7. Returns and/or exchanges will be honoured only if the original cash register receipt is presented at the time of the return and/or exchange. CD Plus Points will be deducted automatically from the CD Plus Points Member's card number that was used for the original purchase (whether or not the CD Plus Points Card is presented at the time of return and/or exchange). The CD Plus Points Member will be reimbursed for the full purchase price of the item(s) returned. Upon the return and/or exchange of purchases earned through the redemption of CD Plus Points, all redeemed CD Plus Points will be forfeited.

8. CD Plus Points are non-transferable.

9. CD Plus Points are reduced to zero upon closure of a CD Plus Points Membership.

10. Upon the death of a CD Plus Points Member, the Member's account will be closed and any CD Plus Points in the account will be forfeited.

C. Tracking Your CD Plus Point Balance

1. All CD Plus Points are shown on the cash register receipt for each purchase when a CD Plus Points Card is presented before the completion of the purchase transaction. In the event that CD Plus Points do not appear on a receipt due to a technical failure, they will be updated on the cash register receipt at a later purchase transaction date.

2. All CD Plus Points totals, as shown on the cash register receipts, will be deemed correct unless otherwise substantiated by the member by bringing forward evidence satisfactory to       CD Plus in its sole discretion. Discrepancies must be addressed with the Store Manager within    3 months of the date on which the discrepancy occurred.

D. Redemption of Points

1. CD Plus Points Members can redeem CD Plus Points in any CD Plus store once they have accumulated the minimum required number of Points to qualify for a CD Plus Points Reward.

2.  CD Plus Points may be redeemed for cash discounts off in store purchases according to the following schedule:

3. In accordance with federal and provincial tax legislation, GST, PST, HST and any other applicable taxes are calculated and payable by the CD Plus Points Member on the full amount of the purchase price before any reduction for redeemed rewards.

4. A Member's CD Plus Points balance will be reduced by the number of Points required to obtain the desired point redemption level. Unredeemed CD Plus Points plus any CD Plus Points earned in the current transaction, will remain in the Member's CD Plus Points account and can be applied to a subsequent transaction.

5. CD Plus Points can only be redeemed if the required point redemption level is acquired prior to the redemption transaction. An individual CD Plus Points Member may not make more than three redemptions, at any reward level, within one calendar day.

6. CD Plus Points may not be redeemed by any person other than the CD Plus Points Member. CD Plus Points Members may be required to provide proof of identity when redeeming CD Plus Points to protect the integrity of the Member's points balance.

7. CD Plus Points have no cash value and are not exchangeable for cash. CD Plus Points cannot be sold or purchased. CD Plus Points are void if sold for cash or any other consideration.

E. CD Plus Points Member’s Privacy Information

1. CD Plus shall maintain the privacy, security and integrity of all personal information collected from CD Plus Points Members, such as, but not restricted to: name, address, telephone numbers, date of birth and purchasing information. This information will be used to credit the correct membership number account, to communicate with the CD Plus Points Member, to better understand the CD Plus Points Member's shopping and information needs and to offer the CD Plus Points Member relevant information, products, services and rewards to meet those needs.

2. On occasion CD Plus may collect additional personal information from CD Plus Points Members on a voluntary basis through questionnaires or other methods. The CD Plus Points Membership status of any Member who does not wish to participate will not be affected.

3. CD Plus will not give, rent or sell its CD Plus Points Member lists to any organization or individual. CD Plus will allow limited and secured access to customer information by authorized entities under its strict supervision solely for the purposes of assisting CD Plus in processing customer information.

4. On occasion CD Plus may communicate through email special offers, information and services to CD Plus Points Members. Any Member who does not wish to receive these offers may indicate so on his/her enrollment form in the designated area.

5. CD Plus hereby agrees to respect and observe the provisions set forth in The Personal Information Protection and Electronic Documents Act (the "Act") and any other applicable legislation. To the extent there is additional protection afforded to the CD Plus Points Member pursuant to the Act or any other applicable legislation, and same is not set forth herein, CD Plus agrees to take such measures to give full effect to such additional protection.

F. General Information

1. CD Plus Points Members should advise CD Plus immediately of any changes of personal information including name, address, telephone numbers and e-mail by emailing the changes to points@cdplus.com.

2. Any unauthorized reproduction of the CD Plus Points Card may lead to legal prosecution and forfeiture of all CD Plus Points and membership in the Program.

3. In case of a lost CD Plus Points Card, upon presentation of proper identification a new Member's number will be provided to the Member by the Store Manager or at any participating CD Plus store. The accumulated unredeemed CD Plus Points balance shall remain intact. If a lost CD Plus Points Card is found and used by any other person, all CD Plus Points relating to purchases made by such other person will be credited to the CD Plus Points Member's account. CD Plus assumes no liability or responsibility for CD Plus Points redeemed by any person(s) prior to the notification to the store. Any CD Plus Points redeemed prior to notification shall be at the Member's risk.

4. The CD Plus Points Card is the property of CD Plus and it may be revoked at any time by CD Plus in its sole discretion.

5. CD Plus will not be liable or responsible in any manner for any tax consequences which may flow from any participation in the CD Plus Points Program by any non-Canadian resident, and where permitted by CD Plus, by any corporation, business, charity, partnership or enterprise.

6. CD Plus may restrict, suspend or otherwise alter any aspect of the CD Plus Points Program, without notice. Any material changes to these Terms and Conditions will be posted in participating stores and a copy of the Terms and Conditions will be made available upon request.

7. The CD Plus Points Member's signature on the CD Plus Points Customer Enrollment Form and/or first time usage of a CD Plus Points Card constitutes agreement by the CD Plus Points Member to all the Terms and Conditions of the CD Plus Points Program.

8. Any abuse by a Member of the CD Plus Points Program's privileges, any failure by a Member to follow the Program's rules, regulations, Terms and Conditions, or any misrepresentation by a Member may, at CD Plus's sole discretion, subject the Member to expulsion from the Program, including forfeiture of all accumulated CD Plus Points.

9. Upon suspension or termination of the Program for any reason whatsoever, CD Plus will have no liability therefor to any Member and is automatically released from all claims by CD Plus Points Members in respect of such suspension, termination, forfeiture of CD Plus Points, redemption of points or otherwise in respect of such suspension or termination.

10. Any waiver by CD Plus of the strict observance, performance or compliance by a Member with any of the Terms and Conditions contained herein, either expressly granted or by course of conduct, shall be effective only in the specific instance and shall not be deemed to be a waiver of any rights or remedies of CD Plus as a result of any other failure to observe, perform or comply with the Terms and Conditions. No delay or omission by CD Plus in exercising any right or remedy hereunder shall operate as waiver thereof or of any other right or remedy.

11. By redeeming CD Plus Points for rewards the CD Plus Points Member releases CD Plus from any and all liability and claims regarding the redemption and use of the reward and any loss or damage caused by goods and services supplied as a reward.
